facing 30 years in prison after federal prosecutors charged him with misusing presidential campaign funds to cover up the affair we with real hunter and the child they had together. on in this ninth day of deliberations, it took a strange turn when it was announced that the jur he reached a verdict. new, apparently, the judge mistakenly believed the jurors had reached a full verdict on all six counts but, you know, that is not what happened. the jury told the judge they had a unanimous decision on one charge involving the money from the 100-year-old wealthy northern virginia heiress, melon. and edwards is accused of masterminding millions of her money along with another donor. -- the mistress as he ran for president in 2008. observers in the courtroom said that edwards looked happy when this announcement was going on and he was smiling at his

family. the attorneys noted and argued immediately this afternoon for a mistrial on all of the other counts. one of the verdict announced. that was not announced at first and later it was. the judge told the jurors to keep deliberating, they went back in and came out 45 minutes later and said this is what it was. they had deadlocked on the five counts and reached a not guilty verdict of the other, so, this is the end now. the john edwards trial is over for now. the defense team had argued strongly. the money in question here was never part of the campaign contributions but, instead, were personal gifts from edwards' friends. we're monitoring this at the courthouse. if john edwards comes out to speak, we'll bring that to you as soon as it happens. >> is there any indication prosecutors may retry him on the five counts? >> reporter: that is a possibility. until we see some of the people come out of this courtroom at this point, laura, that is just conjecture at this point. i can tell you in the last

singing ] >> reporter: chuck brown is dead at 75. gone and with on and the go go hall of fame to be named after him, he will not be forgotten. shawn? >> indeed. karen gray houston, thank you for sharing that tonight. and to a developing story in the district. a water main break on a busy stretch of road in northwest. creating traffic and business problems all day long. it happened this morning on connecticut avenue and n street. john has more. >> reporter: let's start with traffic. if you widen out, at least connecticut avenue is opened in both directions now and northbound connecticut avenue is open two to three lanes of traffic almost normal. southbound, unfortunately, only one lane of cars is getting by. let's go to the hole now. the water main that broke was installed in 1947. and that is a cast iron pike and nobody knows why they break

but it's pretty old and the reason it's taking so long to get to it, it's -- changing a whole section of pipe and on top of the water main, there are power cables, optical power cables and telephone lines. if they move too fast, they create more problems and, believe me, this neighborhood today had problems early on, it looked like a puddle on the corner of connecticut avenue and n street. inconvenienced, if you will, for the low-paying cuts. early responding d.c. waterworkers knew there was a big problem underground. and when they managed to open the northbound manhole covers, more water began rushing out because part of the roadway had begin collapsing from the rushing water below. the fire police officials closed down the vehicle and pedestrian traffic on connecticut avenue. the lack of water closed main

restaurants. >> and -- on a thursday. it's a beautiful day outside and that is out and about and -- we were close to the day and we apologized. without the water and we were not able to open up today. >> reporter: some nearby office buildings were ordered evacuated by d.c. fire marshals. the fear was compromised electrical systems. >> in this downtown building, the water came in longside the main electrical copdue it and not all the way up in the street. in this case, the water certainly is -- >> the underground arrived in and got filled with water. the managers ordered cars to be towed out. and that electrical room was flooded. >> and that did not cause problems and they will need to

be replaced. >> have to do it. >> have to do it. they were waterlogged. >> reporter: the supervisors for d.c. water estimate it's going to be until midnight, at least, until water restoration occurs in the northbound buildings and there is so much underhighway patrolling of m street, that d.c. water would put in a patch and a month or two, come back for repairs for the streets and to convince d.c. to do a permanent repair and -- to do a permitten in repair. and this pile driver is knocking out more in the roadway. they found at least three valves that need to be replaced. tomorrow, connecticut avenue is probably open, n street in the neighborhood is probably not. back to you. >> brian, that is already a mess down there and there is no

fun for anyone having a part of that and thank you. >> a fiery crash killed a driver of the car. the car hit a telephone pole in marlborough pike until 3 a.m. the accident brought down wires that caught fire and pepco crews cut the fire to the lines before firefighters could get to the car. the driver was pronounced dead at the scene. it was yanked off of the road. the feds shut down 26 bus companies to transport the passengers from new york to florida after a yearlong investigation. the government determined the company was a danger to public safety and the investigation focused on three major companies and on to i-95 coach and new century travel and the tony bus express line in bowie, maryland. and back to the big story tonight. john edwards at the podium today after a mistrial was descleared. >> and almost 9 full days

deliberating, trying to reach a fare and just result into the evidence of the law and all i could say is thank goodness we live in the country that has the kind of system we have and i think the jurors are exemplary for what they were supposed to do in this country. they were very, very impressive. the second thing i want to say a word about is responsibility. and this is about me. i want to make sure that everyone hears from me and from my voice that while i do not believe i did anything illegal or ever thought i was doing anything illegal, i did an awful, awful lot that was wrong. and there is no one else responsible for my sins. none of the people who came before and testified are responsible. nobody working for the government is responsible. i am responsible.

and if i want to assign a person who should be held a countable for my sips, honestly, i -- sins, honestly i don't have to go any further than the mirror. it's me. me and me alone. next thing i want to say a word about is for people i love, it's been an incredible experience for me to watch. my parents, my dad just turneddity, my mom is 78 and -- they come here from robins, north carolina, every day to be with me and to support me and i love it so much and they did a wonderful job raising me and me brother blake and sister kathy, who i also love dearly. i also want to say a word about my own children. kay, who all of you have seen, has been here every single day. she has been here no matter

what, no matter how awful and painful a lot of the evidence was for her. the evidence about her dad, evidence about her mom. who show loved so, so dearly. but she never once flinched. me is said i live, i will be there for you no matter what and i am so proud to have had her with me throughout the process and finally, emma, who turned 14 recently, emma and jack who just turned 12 who i take care of every day, and i have not been able to see them as much, but i see them in the morning, i get their breakfast ready, get them off to school and then we get home at night and all eat supper together. i love them both so dearly. y that such an important part of every day of -- they're such an important part of every day of my life and finally, my

precious quinn who i love more than any of you can ever imagine. and i am so close to and so, so grateful for quinn. i'm grateful for awful my children, including my son wade who we lost years ago but, you know, this is the last thing i will say. i don't think god is threw with me. i believe there is some good things i have to do and whatever happens, what i'm hopeful about is all of the kids i see in the porest part of the country and in the world that i can help them. and in whatever way i am capable of helping them. and i want to dedicate my life to being the best dad i can be

and to help the kids who i think deserve help and who i hope i can help. thank you all very much. >> you have been listening to john edwards coming out to spoke a second ago and he was acquitted on one charge of campaign finance fraud and there was a mistrial. he came out to speak outside of the courthouse saying that while he did not believe he did anything wrong with regard the campaign finance violations, he said he did a lot that was wrong and took responsibility for his own sins. >> you saw his daughter kate there by has side, his mother and father, both 80 and 78 years old by his side as well. his daughter kate has been with him every day of the trial. the jurors today said they could not decide if he illegally used money to hide his pregnant mistress while running for president. a mistrial declared on five counts and put him on one count

1,000 names on it. first, it was the "time" magazine cover and 9news now controversial breast-feeding photos are making the rounds and this time, this is involves military moms nursing in uniform. this is a warning. they may make some uncomfortable. two air national guard members breast-feeding on a base and this comes less than a month after the controversial "time" magazine cover that you may remember. i want to bring in pat shell, the director of the breast- feeding center for greater washington. thank you for being with us tonight and to talk about this. some who have seen this say it's their fundamental right. others have compared this to defecating in uniform. what is your response to that? >> reporter: when i hear that, it's sad, the remarks anyone can make. it's sad that anyone in the culture can be shocked by the basic act of breast-feeding one's baby women are allowed to

eat in uniform. so, it's not -- if it's considered, not considered unprofessional to feed one's self in uniform, you can't be denied to feed one baby's in uniform. >> huh. >> and full disclosure here, i have three children myself and nourished all three and i hate to play devil's advocate here, would it be too too much ask a mother in uniform to change into civilian clothing before nurse something. >> women today are already hurt, facing so many hurdles with breast feeding. when our women go back to work, they're now continuing to deal with adjustments to motherhood, the new baby, family priorities and trying to maintain a pumping schedule, location to use a breast pump, pump supplies and maintain a breast- feeding connect. if we tell women in the military to change their cloths to connect and breast-feed her baby, that can seriously

compromise the woman's ability to breast-feed. >> and puts a lot of stress. >> a lot of stress. >> and what is that to say that this is still sparking controversy. mothers have been nursing their babies since the beginning of time. >> the act of breast-feeding should not be a shock to our culture and subject to discussion. the biggest travelsty is the nutrition and proper foods fed to our babies from earth. lack of breast-feeding is leading towards childhood obesity, diabetes and heart disease. women need to defend their babies. our military should be a part of that. >> all right. should there be a policy in the military that, you know, they continue to talk about this? the military? >> i am proud of our military women. this is another way the military can show acceptance, recognizing equality, importance of a woman defending our country and also defending and protect her family and baby. so this could be one more

. a colorful parade in downtown d.c. today. and this is people cheering on the sidewalk and wait for example marching bands. >> and this is a protest parade against wal-mart moving into the district even though they plan to create more than 2,000 jobs. matt ackland has the details on the controversy. >> reporter: are d.c. leaders in bed with wal-mart? some people are sunset the mayor and couple are not pushing wal-mart to be a better employer. thursday, a large group of protestors put on from one of wal-mart's proposed signs on new jersey avenue to wal-mart's d.c. headquarters. for many people here, wal-mart

mart and for too long they have had to go too far for shopping. wal-mart will offer comp pettative wages and won't say how much employees will make in d.c. and they will say on average in virginia, 11 degrees 99 know an hour n maryland, $11.87 an hour. many protestors here say that d.c. leaders should know exactly how much wal-mart will pay before allowing them to build. in the district, matt ackland, fox 5 news. >> they will generate huge tax up to $10 million a year in the district. the big apple proposes a ban on sugary drinks. good idea or should the government butt out of our business? we'll talk to experts. and the city confirm that old people smell different. not so bad. the details are next.

we're up to 85 degrees out and the big difference is the humidity is lower and can you see here, quantico at 89 and that is warm. that has a lot to do with the win directions and what we call a downsloping effect to help the temperatures pop up. even though you are not noticing it so much. gaithersburg, 79; martinsburg, 79; winchester, 79 degrees as well and through the evening, we'll keep that humidity nice and comfortable. eighty degrees at 7:00 and by 9:00, 75 and under mainly clear skies. later tonight, some clouds roll in. i think around 11, we'll notice the clouds and a temperature of 72 and the warm front is coming through later tonight. we can begin to so a couple of showers showing up with that through southwestern virginia. closer to 4, 5:00 in the morning, we might see a couple getting in here. once the warm front goes through, we will keep an eye on what is happening through the chicago area and to the south. we have had reports of wind

damage and this lone so far hasn't produced tornados. we think as it's closer to the east tomorrow, that is going to not only increase the humidity around here, but also some jet level energy that get some of the storms rotating and those rotating storms could potentially be strong and producing wind damage and isolated tornados. we going to have to watch tomorrow afternoon. start watching around 4 or 5:00. conveniently, we'll be on the air to let you know what we see coming in our direction. we do know this: the storm prediction center is from southern to central pennsylvania all the way down to the carolinas and we'll have to watch tomorrow afternoon. for potentially large hail, damaging winds, and you know, we have had a lot of rain in the area and these are slow moving storms that can produce flat flooding. we have to watch. in particular, the storms tomorrow afternoon show the potential is possibly rotating and that is when we get the isolated tornado rift. we watch that for you and this is future cast.
